These Terms of Service ("Terms") constitute a legally binding agreement between you (the "School", "User", or "Client") and SK EduSoft ("Company", "we", "us", or "our") governing your access to and use of the SK EduSoft Pro School ERP platform, software, and related services. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

Agreement to Terms

By accessing or using SK EduSoft Pro services, you agree to these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

Modifications

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of any material changes by sending an email to the registered account email or displaying a prominent notice on our platform. Continued use of the service after changes constitutes acceptance of the new Terms.

Age Requirement

You must be at least 18 years old or have the legal authority to enter into contracts on behalf of your institution to use our services. By using SK EduSoft, you represent that you meet this requirement.

2. Description of Service

SK EduSoft Pro Platform

SK EduSoft Pro is a cloud-based School ERP (Enterprise Resource Planning) software designed for educational institutions. Our services include:

Student admission and enrollment management
Attendance tracking (students and staff)
Fee management and online payment processing
Examination scheduling and result management
Transport and GPS tracking
Parent-teacher communication portal
Library management
Payroll and HR management
Custom school website

Service Availability

We strive to maintain 99.9% uptime for our platform. However, we reserve the right to perform scheduled maintenance (typically during off-peak hours) and cannot guarantee uninterrupted service due to factors beyond our control, including internet outages, natural disasters, or third-party service failures.

3. Account Registration & Responsibilities

Account Creation

To use SK EduSoft Pro, the school administrator must register for an account by providing accurate, current, and complete information. You agree to maintain and promptly update this information to keep it accurate.

Account Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Immediately notifying SK EduSoft of any unauthorized use of your account
Ensuring that all sub-users (teachers, staff) comply with these Terms

One Account Per Institution

Each school or institution is permitted one primary subscription account. Multi-branch schools may require separate plans or an Enterprise plan. Please contact us for details.

4. Payment & Billing

Subscription Plans & Pricing

SK EduSoft Pro is offered on a subscription basis. Current pricing plans are available at our Pricing page. Prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes (GST).

Payment Methods

We accept the following payment methods:

UPI (Google Pay, PhonePe, Paytm, BHIM)
Credit and Debit Cards (Visa, Mastercard, RuPay)
Net Banking
Bank Transfer (NEFT/RTGS) — for annual plans only

Billing Cycle & Auto-renewal

Subscriptions are billed monthly or annually as chosen. Annual subscriptions are billed upfront for the full year. Your subscription will automatically renew at the end of each billing period unless you cancel at least 7 days before the renewal date.

Free Trial

We offer a 30-day free trial for new customers. No credit card is required during the trial. At the end of the trial, you may choose a plan to continue; otherwise, your access will be suspended.

Refund Policy

If you are not satisfied with our service within the first 30 days of a paid subscription, you are eligible for a full refund. Refund requests after 30 days will be considered on a case-by-case basis. Annual plan refunds are prorated based on unused months. Late Payment

If payment is not received within 7 days of the due date, we reserve the right to suspend your account. Data will be retained for 30 days after suspension before permanent deletion.

5. Acceptable Use Policy

Permitted Use

SK EduSoft Pro may only be used for lawful purposes related to school management, student administration, and education-related activities within your institution.

Prohibited Activities

You agree NOT to:

Use the platform for any illegal purpose or in violation of Indian laws
Upload or share malware, viruses, or harmful code
Attempt to gain unauthorized access to our systems or other users' accounts
Use the platform to harass, bully, or harm students, parents, or staff
Resell or sublicense access to SK EduSoft to third parties without written consent
Reverse-engineer, decompile, or disassemble our software
Use automated scripts or bots to access our platform
Upload content that infringes on any intellectual property rights
Store or process information that violates applicable data protection laws

Consequences of Violation

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund, and may be reported to appropriate law enforcement authorities.

6. Intellectual Property

Our Intellectual Property

All content, features, and functionality of SK EduSoft Pro — including but not limited to software code, design, logos, text, graphics, and user interface — are owned by SK EduSoft and are protected by Indian and international copyright, trademark, and other intellectual property laws.

Your Data Ownership

You retain full ownership of all data you enter into the platform, including student records, fee data, and school information. By using our service, you grant SK EduSoft a limited, non-exclusive license to process this data solely to provide and improve our services.

Feedback

If you provide us with feedback, suggestions, or ideas about our service, you agree that we may use this feedback without any obligation to compensate you.

7. Data & Privacy

Data Processing Agreement

By using SK EduSoft Pro, you enter into a Data Processing Agreement with us. As the school (Data Controller), you are responsible for lawfully collecting data from students and parents. SK EduSoft (Data Processor) will process this data only as instructed by you and as described in our Privacy Policy.

Data Portability & Export

You can export all your school data at any time from the admin panel. We support exports in CSV, Excel, and PDF formats. Upon termination of service, you have 30 days to export your data before it is permanently deleted.

Student Data Protection

We take the privacy of student data extremely seriously. Student personal data is never used for advertising purposes, never sold to third parties, and is only accessible to authorized school staff within your institution.

8. Limitation of Liability

Disclaimer of Warranties

SK EduSoft Pro is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses.

Limitation of Damages

To the maximum extent permitted by applicable law, SK EduSoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of business, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the service in the 3 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless SK EduSoft, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: your use of the service, your violation of these Terms, or your violation of any third-party rights.

9. Termination

Termination by You

You may cancel your subscription at any time from the account settings or by contacting our support team. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused portions of the current billing period (except within the 30-day money-back guarantee window).

Termination by SK EduSoft

We may terminate or suspend your account immediately without notice if:

You breach any provision of these Terms
You fail to pay subscription fees within the grace period
We are required to do so by law
We decide to discontinue the service (with 60 days' prior notice)

Effect of Termination

Upon termination, your right to use the service will immediately cease. We will provide 30 days for you to export your data. After this period, your data will be permanently and irreversibly deleted from our servers.

10. Governing Law & Dispute Resolution

Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

Dispute Resolution

In the event of any dispute, we encourage you to first contact us to seek an informal resolution. If the dispute cannot be resolved informally within 30 days, either party may seek mediation before initiating formal legal proceedings.
